Granting financial assistance
§ 1.
This document defines the rules for granting financial assistance from the “Zakłady Kórnickie” Foundation to legal persons, to organizational units which do not have a legal personality but have legal capacity pursuant to separate regulations, and to natural persons.
§ 2.
Financial assistance may be granted for the purposes specified in the Act of 18th September 2001, about the foundation – Zakłady Kórnickie (Journal of Laws of 2001, No. 11, item 1451) and the Statute of the Foundation.
§ 3.
Financial assistance is granted by way of a resolution adopted by the Board of the “Zakłady Kórnickie” Foundation. There is no appeal against the resolution of the Foundation Board regarding the granting of financial assistance.
The resolution of the Board on granting financial assistance specifies the entity, and the purpose for which the assistance was granted, the amount and the payment method.
§ 4.
Financial assistance is granted on the basis of an application submitted in writing to the Board of the “Zakłady Kórnickie” Foundation.
The application should include a description indicating the purposes for which the financial means are to be allocated.
§ 5.
The party that has been granted financial assistance is required to submit a written statement on spending of the funds for purposes consistent with the application and the resolution of the Board.
The party which has been granted financial assistance in accordance with these regulations is obliged to return the funds that were used contrary to the submitted application or not used.
The statement referred to in section 1 of this paragraph, stating the disbursement of funds allocated by the “Zakłady Kórnickie” Foundation Board, the application referred to in § 4, as well as the resolution of the “Zakłady Kórnickie” Foundation Board regarding the granted financial assistance, will be kept at the Foundation’s headquarters for bodies authorized to control activities of the Foundation.
§ 6.
The Board of the “Zakłady Kórnickie” Foundation is entitled in particular to:
l receiving and processing applications,
l granting financial assistance,
l verifying the correctness of spending of the funds allocated under financial assistance in accordance with the statement made pursuant to § 5 sect. 3,
l signing contracts for financial assistance by the “Zakłady Kórnickie” Foundation in the cases referred to in § 15 of these regulations
The Foundation’s Board, within the powers referred to in § 6 sect. 1 clause 3) controls and assesses the effectiveness and reliability of the spending of funds allocated in accordance with the financial assistance, taking into account the application submitted by the applicant and the declaration submitted pursuant to § 5 sect. 1 of these regulations
If the Board finds irregularities in the expenditure of funds, or that not all the allocated funds are used, the Board obliges the beneficiary to reimburse them in an appropriate amount.
§ 7.
The Foundation Board accepts the applications referred to in § 4 of these regulations by 30th April and 30th October each year. Applications submitted to the Foundation by April 30th will be recognized by the Board no later than 15th May each year; applications received after April 30 and before October 30 will be recognized by the Foundation Board no later than 15th November each year.
§ 8.
Regardless of the granting of financial assistance by submitting individual applications, the Foundation Board may announce that as part of specific activities resulting from the foundation’s objectives, it will provide assistance subject or subject.
The announcement is made in a local or a national daily newspaper, the Public Information Bulletin, the Foundation’s website, as well as at the headquarters of the “Zakłady Kórnickie” Foundation in a place intended for advertisements.
§ 9.
The announcement should include the following information:
l type of assistance;
l deadline for offers submission;
l deadline and conditions of the task;
l deadlines, mode and criteria used when selecting the offer.
§ 10.
The offer should include:
l a detailed description of the material scope of the task proposed to be completed;
l the date and the place of the task completion;
l a calculation of the expected costs of completing the task;
§ 11.
When considering offers the Foundation Board:
l evaluates the offering party’s ability to perform the task;
l evaluates the presented cost calculation of the task;
§ 12.
The Board considers the offer also if one offer is submitted.
§ 13.
The offer’s selection is made in the form of a resolution adopted by the Board. The resolution requires justification. All the offering parties are informed in writing about the resolution the Board has made.
§ 14.
As part of the annual activity report, the Board of the “Zakłady Kórnickie” Foundation submits information to the Curators Board of the “Zakłady Kórnickie” Foundation on the activity consisting in providing financial assistance implemented on the basis of these regulations.
§ 15.
In special cases, the Foundation Board, as part of the implementation of the financial assistance resulting from the objectives of the foundation, may sign contracts to complete a task that is a subject of these regulations.
The agreement referred to in sect. 1 shall specify the detailed rules of providing financial assistance, in particular the mutual rights and obligations of the parties, type of assistance, amount of funds, deadline and conditions of the task completion.
§ 16.
In matters not covered in these regulations, the relevant provisions of applicable law shall apply, in particular the provisions of the Act of 18th September 2001 on the foundation – Zakłady Kórnickie (Journal of Laws of 2001, No. 11, item 1451), the Act of 24th April 2003 on public benefit activities and volunteering (Journal of Laws 2003, No. 96, item 873) and the Statute of the “Zakłady Kórnickie” Foundation.
The regulations were approved on 11th March, 2006, by resolution No. 27 of the Council of Curators of the “Zakłady Kórnickie” Foundation.
